  4.1應(yīng)征申請(qǐng)人（以下簡(jiǎn)稱(chēng)“申請(qǐng)人”）應(yīng)為合法注冊(cè)的法人實(shí)體或由合法注冊(cè)的法人實(shí)體組成的項(xiàng)目聯(lián)合體，且應(yīng)具有與本項(xiàng)目的功能性質(zhì)相類(lèi)似的設(shè)計(jì)經(jīng)驗(yàn)。
  4.1 The Applicant shall be a legal entity that has been legally incorporated in accordance with laws or a project consortium composed of legal entities that have been legally incorporated in accordance with laws,and shall have design experience in a project with the similar functional nature of this Project.

  4.2 Applicants shall have the corresponding eligibility or qualifications to undertake the landscape design and architectural design of this solicitation.

  （1）Design entities within the People's Republic of China should have the following qualification issued by the relevant government administrative department:a qualification certificate of Grade A for landscape engineering design or a qualification certificate of Grade A for architectural design(architectural engineering)or above;

  8.1 Intellectual Property Rights(IPRs)
  8.1.1本次方案征集中接收的所有有效的應(yīng)征文件（包括A3版面設(shè)計(jì)文冊(cè)、A0標(biāo)準(zhǔn)輕質(zhì)展板、電子文件、模型和應(yīng)征設(shè)計(jì)方案著作權(quán)聲明等）均不退回。
  8.1.1 All valid response proposals(including the A3 sized design book,A0 standard lightweight exhibition panel,electronic documents,models,and the Copyright Statement of Design Proposals)received in this solicitation will not be returned.
  8.1.2應(yīng)征設(shè)計(jì)文件和設(shè)計(jì)成果的知識(shí)產(chǎn)權(quán)由主辦單位/承辦單位與應(yīng)征人共同享有。
  8.1.2 The IPRs of the Design Proposals and design results shall be commonly owned by the Sponsor/Organizers and the Participants.
  8.1.3應(yīng)征人對(duì)其應(yīng)征設(shè)計(jì)文件享有署名權(quán)，在征得主辦單位/承辦單位書(shū)面同意后可通過(guò)傳播媒介、專(zhuān)業(yè)雜志、書(shū)刊或其他形式評(píng)價(jià)、展示其應(yīng)征設(shè)計(jì)文件的相關(guān)內(nèi)容。除應(yīng)征人的設(shè)計(jì)標(biāo)準(zhǔn)、設(shè)計(jì)導(dǎo)則和繪圖元素以外，應(yīng)征人不得將應(yīng)征設(shè)計(jì)文件及設(shè)計(jì)成果用于其他的設(shè)計(jì)項(xiàng)目。
  8.1.3 Participants hold the right of authorship for their Design Proposals and can comment on and display such Design Proposals in the forms of media communications,trade magazines,publications among others after granted with the Sponsor’s/Organizers’consent in writing.The Participants shall not use the Design Proposals and design results on other design projects,except the Participants’design standards,design guidelines,and drawing elements.
  8.1.4應(yīng)征人應(yīng)保證提交的應(yīng)征設(shè)計(jì)文件及設(shè)計(jì)成果在中華人民共和國(guó)境內(nèi)或境外沒(méi)有且不會(huì)侵犯任何其他人的知識(shí)產(chǎn)權(quán)（包括但不限于著作權(quán)、專(zhuān)利權(quán)）或?qū)Ｓ屑夹g(shù)或商業(yè)秘密。應(yīng)征人應(yīng)保證，如果其應(yīng)征設(shè)計(jì)文件使用或包含任何其他人的知識(shí)產(chǎn)權(quán)或?qū)Ｓ屑夹g(shù)或商業(yè)秘密，應(yīng)征人應(yīng)已經(jīng)獲得權(quán)利人的合法、有效、充分的授權(quán)。應(yīng)征人因侵犯他人知識(shí)產(chǎn)權(quán)或?qū)Ｓ屑夹g(shù)或商業(yè)秘密所引起的全部賠償責(zé)任應(yīng)由應(yīng)征人承擔(dān)。
  8.1.4 Participants shall ensure that all the submitted Design Proposals and design results have not infringed upon and will not infringe upon IPRs(including but not limited to copyright and patent right)or proprietary technologies or trade secrets of others within or outside the People’s Republic of China.The Participants shall guarantee that if their Design Proposals use or include IPRs or proprietary technologies or trade secrets of others,the Participants shall have already obtained legitimate,valid and sufficient authorization from the right holders.The Participants shall take all liabilities for any compensations arising from infringement upon IPRs or proprietary technologies or trade secrets of others.
  8.1.5主辦單位/承辦單位有權(quán)在本項(xiàng)目的規(guī)劃設(shè)計(jì)中使用應(yīng)征人提交的規(guī)劃設(shè)計(jì)成果，主辦單位/承辦單位在項(xiàng)目的規(guī)劃設(shè)計(jì)中或在規(guī)劃設(shè)計(jì)方案調(diào)整綜合時(shí)可以全部或部分使用應(yīng)征規(guī)劃設(shè)計(jì)成果的內(nèi)容，也可以對(duì)其進(jìn)行修改。主辦單位/承辦單位不得將應(yīng)征設(shè)計(jì)文件及設(shè)計(jì)成果用于本項(xiàng)目以外的其他項(xiàng)目。
  8.1.5 The Sponsor/Organizers have the right to use the planning and design results submitted by the Participants in the planning and design of this Project.The Sponsor/Organizers are allowed to use the Design Proposals in whole or in part in the planning and design of this Project or the adjustment and integration of the planning and design proposals,and have the right to modify them.The Sponsor/Organizers shall not use the Design Proposals and design results for a purpose other than this Project.
  8.1.6主辦單位/承辦單位可以對(duì)所有應(yīng)征設(shè)計(jì)文件及設(shè)計(jì)成果印刷、出版和展覽，并可通過(guò)傳播媒介、專(zhuān)業(yè)雜志、書(shū)刊或其他形式評(píng)價(jià)、展示、宣傳應(yīng)征設(shè)計(jì)文件及設(shè)計(jì)成果，但應(yīng)注明設(shè)計(jì)機(jī)構(gòu)的名稱(chēng)。
  8.1.6 The Sponsor/Organizers can print,publish and exhibit all the Design Proposals and design results,or comment on,display and publicize the Design Proposals and design results via media communications,trade magazines,publications or by other means.The precondition is indication of the names of design entities for such design.
  8.1.7應(yīng)征建筑設(shè)計(jì)方案（如果有）的著作權(quán)歸屬于應(yīng)征人，但景觀小品及其建構(gòu)筑物除外。
  8.1.7 The copyright of architectural design proposals(if any)shall belong to the Participants,except for landscape embellishments and their structures.
  8.2應(yīng)征設(shè)計(jì)補(bǔ)償金
  8.2 Compensations for Designs Proposals
  承辦單位將向按征集文件的要求在規(guī)定的時(shí)間內(nèi)提交了有效應(yīng)征文件的應(yīng)征人支付應(yīng)征設(shè)計(jì)補(bǔ)償金，金額為人民幣140萬(wàn)元（含稅）。當(dāng)應(yīng)征人出現(xiàn)下列情況時(shí)，承辦單位將不予支付補(bǔ)償金：
  The Organizers will pay compensations for design proposals in the amount of RMB 1.4 million(including tax)for any Participant that has submitted valid response documents within specified time frame as required per Solicitation Documents.The Organizers will not pay any compensation when Participants are under any of the following circumstances:
  （1）應(yīng)征人未按規(guī)定時(shí)間提交應(yīng)征文件；
  （1）Participants fail to submit their response proposals within the specified time;
  （2）應(yīng)征人提交的應(yīng)征文件經(jīng)專(zhuān)家委員會(huì)評(píng)審被認(rèn)定為未對(duì)征集文件要求作出實(shí)質(zhì)性響應(yīng)；
  （2）The response proposals submitted by Participants are judged,upon the expert review,as not substantially responding to the requirements of the Solicitation Documents;
  （3）應(yīng)征人被取消應(yīng)征資格。
  （3）Participants are disqualified.
  8.3獎(jiǎng)項(xiàng)和獎(jiǎng)金的設(shè)置
  8.3 Awards and prize settings
  本次方案征集將評(píng)選出1個(gè)優(yōu)勝設(shè)計(jì)方案，獎(jiǎng)金為人民幣60萬(wàn)元（含稅），獲獎(jiǎng)的應(yīng)征人需結(jié)合評(píng)審專(zhuān)家意見(jiàn)和主辦單位/承辦單位的要求對(duì)其應(yīng)征設(shè)計(jì)方案進(jìn)行一輪方案優(yōu)化，并提交相應(yīng)設(shè)計(jì)成果（不含模型動(dòng)畫(huà)）。
  This solicitation will select one winning design proposal,with a prize of RMB 600,000(tax included).The winning Participant will be required to refine their design proposal based on the opinions of the review experts and the requirements of the Sponsor/Organizers,and submit the corresponding design results(excluding model animations).
  8.4適用法律
  8.4 Governing Laws
  本次征集活動(dòng)本身及與本次活動(dòng)相關(guān)的文件所適用的法律和法規(guī)僅為中華人民共和國(guó)的法律和法規(guī)。
  The solicitation per se and any documents relating thereto shall be governed only by the laws and regulations of the People’s Republic of China.
  8.5語(yǔ)言
  8.5 Languages
  資格預(yù)審文件以及與資格預(yù)審文件相關(guān)的補(bǔ)充文件和澄清文件均使用中文和英文書(shū)寫(xiě)。申請(qǐng)文件應(yīng)使用中文書(shū)寫(xiě)，申請(qǐng)人隨申請(qǐng)文件提供的證明文件和印刷品可以使用另一種語(yǔ)言，但應(yīng)附中文譯本。在中文與其他語(yǔ)言的意思表達(dá)不一致時(shí)，以中文為準(zhǔn)。
  The language used in the Prequalification Documents and any supplement and clarification documents thereto shall be Chinese and English.Application Documents for Prequalification shall be drafted in Chinese.Another language can be used for the proof documents and printed materials that Applicants provide along with the Application Documents,but the version with Chinese translation shall be attached thereto.In the case of inconsistent expressions in both Chinese and another language,the Chinese version shall prevail.
