  成都交子公園置業(yè)有限公司作為征集人(下稱“征集人”)委托四川明清工程咨詢有限公司作為征集代理(下稱“征集代理”),組織“交子公園金融商務(wù)區(qū)河?xùn)|特色金融街項(xiàng)目、交子公園東區(qū)A/E地塊項(xiàng)目景觀概念方案征集項(xiàng)目”活動(dòng),面向全球公開(kāi)邀請(qǐng)具有相關(guān)設(shè)計(jì)經(jīng)驗(yàn)的設(shè)計(jì)機(jī)構(gòu)前來(lái)申請(qǐng)應(yīng)征,遞交資格預(yù)審《申請(qǐng)文件》。征集人將通過(guò)本次資格預(yù)審,擇優(yōu)選取3位應(yīng)征人參加征集活動(dòng),《征集文件》(含《設(shè)計(jì)任務(wù)書》)僅提供給入圍的3家應(yīng)征人。歡迎符合資格條件的應(yīng)征申請(qǐng)人遞交資格預(yù)審《申請(qǐng)文件》。
  Chengdu Jiaozi Park Real Estate Co.,Ltd.(hereinafter referred to as the“Host”)entrusts Sichuan Minkin Consulting Co.,Ltd.as Solicitation Agent(hereinafter referred to as“Solicitation Agent”)to organize the Landscape Conceptual Scheme Solicitation for Hedong Characteristic Financial Street Project of Chengdu Jiaozi Park Financial Business District and East Zone Plot A/E Project of Chengdu Jiaozi Park and invites design agencies with relevant design experience worldwide to apply and submit pre-qualification Application Documents.Through this pre-qualification,the Host will select three applicants to participate in the solicitation activity and the Solicitation Documents(including the Design Brief)will only be provided to the three shortlisted applicants.Applicants who meet the eligibility criteria are welcome to submit the pre-qualification Application Documents.

  1.資格預(yù)審
  1.Pre-qualification
  征集人和征集代理將組建資格預(yù)審評(píng)審委員會(huì),對(duì)按時(shí)遞交了資格預(yù)審《申請(qǐng)文件》的應(yīng)征申請(qǐng)人進(jìn)行審查和評(píng)審,擇優(yōu)選取3位應(yīng)征人參加征集活動(dòng)。
  The Host and Solicitation Agent will set up a pre-qualification review jury to examine and review the applicants who have submitted the pre-qualification Application Documents on time,and three applicants will be selected to participate in the solicitation activities.

  The Host and Solicitation Agent will set up an expert scheme review jury to conduct a comprehensive review of the landscape conceptual schemes for Hedong Characteristic Financial Street Project of Chengdu Jiaozi Park Financial Business District and East Zone Plot A/E Project of Chengdu Jiaozi Park,and rank landscape conceptual schemes for these projects submitted by three applicants.
  3.中選方案的確定
  3.Determination of the selected scheme
  征集人在向相關(guān)政府主管單位和部門匯報(bào)了專家評(píng)審結(jié)果,并征詢了相關(guān)政府主管單位和部門的意見(jiàn)后,從3個(gè)方案中確定1個(gè)為中選方案。

  4.深化設(shè)計(jì)咨詢

  征集人在確定中選方案后,將與中選單位簽訂深化設(shè)計(jì)咨詢合同,完成景觀方案深化設(shè)計(jì)咨詢、方案報(bào)規(guī)報(bào)建配合、施工實(shí)施階段配合等顧問(wèn)工作。深化設(shè)計(jì)咨詢費(fèi)由應(yīng)征人自行報(bào)價(jià),與景觀概念方案設(shè)計(jì)成果同時(shí)遞交。深化設(shè)計(jì)咨詢費(fèi)的報(bào)價(jià)將被作為概念方案評(píng)審的重要考慮因素之一。
  After determining the selected scheme,the Host will sign the design development consulting contract with the selected units and complete the design development consulting of the landscape scheme,the cooperation of the scheme submission to planning and construction authorities,the cooperation of the construction implementation stage and other advisory work.The design development consulting fee will be quoted by the applicant on its own and submitted at the same time with the deliverables of the landscape concept scheme.The quotation for the design development consulting fee will be considered as one of the factors in the conceptual scheme review.

  (1)將交子公園、交子人行橋、街道、特色樓宇無(wú)界融合,打造高質(zhì)量社交場(chǎng)景與綠色生活美學(xué)場(chǎng)景。
  (1)Seamlessly integrate Jiaozi Park,Jiaozi Footbridge,streets and characteristic buildings to create high-quality social scenes and green life aesthetic scenes.
  (2)強(qiáng)調(diào)格調(diào)品味、自然藝術(shù)場(chǎng)景、輕奢質(zhì)感,構(gòu)建公園經(jīng)濟(jì),形成多元文化社區(qū),以無(wú)界交融的商業(yè)場(chǎng)景賦能河?xùn)|特色金融街區(qū)商業(yè)長(zhǎng)期價(jià)值IP。

  (2)滿足編制估算文件及業(yè)主后續(xù)施工圖招標(biāo)的要求;

  (3)滿足征集人及征集人委托的咨詢機(jī)構(gòu)提出的相關(guān)審查;

  (4)應(yīng)滿足現(xiàn)行相關(guān)規(guī)范要求;

  (1)方案征集及方案深化咨詢圖紙尺寸為A3版面(據(jù)實(shí)際情況可適當(dāng)加長(zhǎng)),PowerPoint式文件作為方案匯報(bào)時(shí)的主要文件。
  (1)The size of the scheme solicitation and scheme development consulting drawings is A3(which can be appropriately extended according to the actual situation),with PowerPoint file as the main document for scheme reporting.
  (2)最終評(píng)審須提交方案文本紙質(zhì)版本共8套(正式文件蓋鮮章及騎縫章),并制作3-5分鐘的視頻或動(dòng)畫,格式為MP4。
  (2)A total of 8 sets of hardcopy documents of the scheme text(with fresh seal and across-page seal affixed in the official documents)must be submitted for the final review.A 3~5-minute video or animation in MP4 format must be prepared.

  1.深化設(shè)計(jì)咨詢費(fèi)
  1.Design development consulting fees
  經(jīng)征集人征詢相關(guān)政府主管單位和部門意見(jiàn)后,由征集人確定的中選單位,將獲得后續(xù)深化設(shè)計(jì)咨詢合同,深化設(shè)計(jì)咨詢費(fèi)控制價(jià)為人民幣739.1981萬(wàn)元(含稅)。應(yīng)征人根據(jù)方案自行報(bào)價(jià),報(bào)價(jià)金額不應(yīng)超過(guò)控制價(jià)。
  After consulting the opinions of the competent government departments,the Host determines the selected unit of each plot.These units will be awarded a subsequent design development consulting contract,and the design development consulting fees will be controlled within RMB 73.91981 million yuan.The shortlisted applicant should quote according to the scheme,and the amount quoted must not exceed the price ceiling.
  具體工作內(nèi)容為:包含但不限于本項(xiàng)目?jī)?nèi)所有的(含屋頂花園、下沉廣場(chǎng)、跨街連橋、室外汽車坡道等)景觀、綠化、硬質(zhì)鋪裝及廣場(chǎng)、園路系統(tǒng)、海綿城市等配套設(shè)施等;并提出公園建筑、室內(nèi)外導(dǎo)視系統(tǒng)、標(biāo)識(shí)標(biāo)牌、公共空間藝術(shù)品/雕塑、兒童區(qū)、燈光氛圍、噴泉水景等專項(xiàng)創(chuàng)意意向,且根據(jù)征集人的要求對(duì)方案征集成果的調(diào)整及優(yōu)化。應(yīng)完成本項(xiàng)目范圍內(nèi)所有的景觀概念方案征集服務(wù)及估算、概念方案深化咨詢服務(wù)及估算、擴(kuò)初咨詢及概算相關(guān)設(shè)計(jì)咨詢服務(wù)工作。
  The specific work contents include but are not limited to all landscape,greening,and hard pavement of(roof garden,sunken square,cross-street bridge,outdoor car ramp)and supporting facilities such as square,parkway system and sponge city in the Project;propose special creative intentions such as park architecture,indoor and outdoor signage systems,signs,public space artworks/sculptures,children's areas,lighting atmosphere and fountain water features,and adjust and optimize the scheme solicitation deliverables according to the requirements of the Host.All landscape conceptual scheme solicitation services and estimation,conceptual scheme development consulting services and estimation,and design consulting services related to initial expansion consulting and estimation within the scope of the Project should be completed.
  2.方案補(bǔ)償費(fèi)

  應(yīng)征人將獲得相應(yīng)方案補(bǔ)償費(fèi)方案補(bǔ)償費(fèi)為人民幣80萬(wàn)元,方案補(bǔ)償協(xié)議將在方案評(píng)審會(huì)結(jié)束后30個(gè)工作日內(nèi)簽訂。方案補(bǔ)償費(fèi)協(xié)議簽訂后,應(yīng)征人在結(jié)合專家意見(jiàn)、相關(guān)政府主管單位和部門意見(jiàn)對(duì)方案進(jìn)行優(yōu)化,并按期向征集人交付優(yōu)化方案并經(jīng)驗(yàn)收合格后開(kāi)始辦理支付手續(xù)。征集人征詢相關(guān)政府主管單位和部門意見(jiàn)后,由征集人確定中選單位后,該單位獲得的方案補(bǔ)償費(fèi)將抵扣其相應(yīng)的深化設(shè)計(jì)咨詢費(fèi)。

  當(dāng)應(yīng)征人出現(xiàn)下列情況時(shí),征集人不予支付方案補(bǔ)償費(fèi)。
  The Host will not pay the compensation when the following circumstances arise.
  (1)應(yīng)征人未按規(guī)定時(shí)間遞交完整的《應(yīng)征文件》;
  (1)The applicant has not submitted the full Application Documents according to the prescribed time;
  (2)應(yīng)征人遞交的《應(yīng)征文件》被方案評(píng)審專家評(píng)審委員會(huì)認(rèn)定為未對(duì)《征集文件》的要求作出實(shí)質(zhì)性的響應(yīng);
  (2)The Application Documents submitted by the applicant is identified by the expert scheme review jury as not making a substantive response to the requirements of Solicitation Documents;
  (3)應(yīng)征人遞交的《應(yīng)征文件》被方案評(píng)審專家評(píng)審委員會(huì)認(rèn)定為未達(dá)到本次征集設(shè)計(jì)工作深度及要求的;
  (3)The Application Documents submitted by the applicant is identified by the expert scheme review jury as not meeting the depth and requirements of the design work of the solicitation;
  (4)方案國(guó)際征集期間,應(yīng)征人的資格條件發(fā)生變化,不能達(dá)到上述第六條規(guī)定的資格要求,被征集人取消應(yīng)征人資格。
  (4)During the international solicitation,if the qualification conditions of the applicant have changed and the applicant fails to meet the qualification requirements stipulated in Article VI above,the applicant is disqualified by the Host.
  3.深化設(shè)計(jì)咨詢費(fèi)、方案補(bǔ)償費(fèi)的支付方式

  本次征集的方案補(bǔ)償費(fèi)及深化設(shè)計(jì)咨詢費(fèi)均以人民幣直接支付給應(yīng)征人,所有中國(guó)境內(nèi)、外應(yīng)繳納的各項(xiàng)稅費(fèi)均由應(yīng)征人自理,須提供符合征集人要求的中國(guó)國(guó)內(nèi)完稅發(fā)票。境外應(yīng)征人若無(wú)法使用本機(jī)構(gòu)帳戶收取人民幣的,須與征集人簽訂三方支付協(xié)議并授權(quán)國(guó)內(nèi)合法獨(dú)立法人代收款項(xiàng),征集人在為應(yīng)征人代扣代繳中國(guó)境內(nèi)勞務(wù)增值稅及所得稅后,將剩余款項(xiàng)支付至其國(guó)內(nèi)合法獨(dú)立法人機(jī)構(gòu),因此產(chǎn)生的所有費(fèi)用由應(yīng)征人自行負(fù)責(zé)。
  The compensation and design development consulting fees of this solicitation will be paid in RMB directly to the applicant,and all taxes and fees payable inside and outside China should be borne by the applicant on its own,and the invoices for domestic tax payment in China should be provided in accordance with the requirements of the host.If the overseas applicant is unable to use its account to receive RMB,it needs to sign a tripartite payment agreement with the host and authorizes the legal and independent legal person in China to receive the payment on its behalf.After withholding and paying the value-added tax and income tax on labor services in China for the applicant,the host will pay the remaining amount to its domestic legal independent legal person,and all expenses incurred therefrom shall be borne by the applicants.

  4.Others
  4.1應(yīng)征人參加本次資格預(yù)審及方案征集的所有費(fèi)用(含差旅住宿費(fèi)、模型制作、打印費(fèi)等)均自行承擔(dān)。
  4.1All expenses(including travel and accommodation fees,model making,printing fees,etc.)for shortlisted applicants participating in the pre-qualification and scheme solicitation are borne by themselves.
  4.2征集人保留要求應(yīng)征人根據(jù)方案評(píng)審委員會(huì)和相關(guān)政府主管單位和部門意見(jiàn)進(jìn)行優(yōu)化成果的權(quán)利。
  4.2The host reserves the right to require the applicants to optimize the deliverables according to the opinions of the scheme review committee and the competent government.
  知識(shí)產(chǎn)權(quán)和保密原則

  1、由征集人提供的資料、軟件和其他物品,其所有權(quán)(包括版權(quán))等合法權(quán)益歸征集人所有。應(yīng)征人將與征集人簽訂保密協(xié)議,未經(jīng)征集人書面同意,應(yīng)征人不得擅自使用或交由任何第三方使用,否則,應(yīng)征人應(yīng)承擔(dān)由此產(chǎn)生的所有責(zé)任并賠償征集人因此遭受的所有損失。即使本項(xiàng)目履行完畢、被解除、終止,應(yīng)征人的保密義務(wù)永久存在,除非上述保密內(nèi)容已經(jīng)被公開(kāi)。
  1.The legitimate rights and interests of materials,software and other articles provided by the Host are owned by the Host,such as ownership(including copyright).The shortlisted applicant will sign a confidentiality agreement with the Host,and the Host must not use it or hand it over to any third party without the written consent of the applicant.Otherwise,the applicant shall bear all liabilities arising therefrom and compensate the Host for all losses suffered therefrom.Even if the Project is performed,rescinded or terminated,the obligation of confidentiality of the applicant will exist permanently unless the above confidentiality has been made public.
  2、應(yīng)征人保證提交給征集人的設(shè)計(jì)圖紙、相關(guān)文件、資料、方案等項(xiàng)目成果(包括中期和最終成果)以及實(shí)現(xiàn)該成果所使用的必要方法不侵犯征集人和任何第三方的合法權(quán)益(包括但不限于專利權(quán)、商標(biāo)、著作權(quán)、廠商標(biāo)識(shí)、服務(wù)標(biāo)記、商業(yè)秘密、公民的肖像權(quán)等),否則,應(yīng)征人應(yīng)承擔(dān)由此產(chǎn)生的所有責(zé)任并賠償征集人因此遭受的所有損失。
  2.The applicant guarantees that the project deliverables submitted to the Host(including interim and final deliverables)such as design drawings,relevant documents,materials,schemes and the necessary methods used to achieve the results do not infringe upon the legitimate rights and interests of the Host and any third party(including but not limited to,patent rights,trademarks,copyrights,manufacturer's signage,service marks,trade secrets,citizen portrait rights,etc.).The applicant should bear all liabilities arising therefrom and compensate the Host for all losses suffered thereinafter.
  3、征集人與中選方案的應(yīng)征人簽署了深化設(shè)計(jì)咨詢合同并支付相應(yīng)深化設(shè)計(jì)咨詢費(fèi)后,中選方案的所有權(quán)及相關(guān)知識(shí)產(chǎn)權(quán)轉(zhuǎn)為征集人與應(yīng)征人雙方共同所有(應(yīng)征人擁有署名權(quán)),征集人有權(quán)將應(yīng)征人遞交的中選概念方案設(shè)計(jì)成果及設(shè)計(jì)咨詢成果用于項(xiàng)目竣工之目的使用。任何一方,未經(jīng)另一方事先同意,不得在任何情況下將本項(xiàng)目的設(shè)計(jì)咨詢成果、設(shè)計(jì)模型、設(shè)計(jì)文件及有關(guān)數(shù)據(jù)進(jìn)行修改、復(fù)制或描繪提供給第三方使用(除為本次項(xiàng)目建造、研討、評(píng)審、報(bào)批目的提供給第三方以外)。如果征集人未能與中選的應(yīng)征人簽署深化設(shè)計(jì)咨詢合同,經(jīng)應(yīng)征人書面同意后,征集人可以使用應(yīng)征人的概念方案設(shè)計(jì)成果。
  3.After signing the design development consulting contract between the Host and the applicant of the selected scheme,the Host is entitled to use the deliverables of the conceptual scheme submitted by the applicant.After the Host pays the design development consulting fees,the ownership and intellectual property rights of the selected schemes shall be owned by the Host(the right of authorship should be owned by the applicant).Neither party shall,without the prior consent of the other party,modify,copy or describe the design consulting deliverables,design models,design documents and related data of the Project to a third party for use under any circumstances(except for the purpose of construction,discussion,review and approval of the Project).If the Host fails to sign a further design development consulting contract with the selected applicant,the Host may,with the written consent of the applicant,use the applicant's conceptual scheme deliverables.
  4、未中選方案的知識(shí)產(chǎn)權(quán)經(jīng)應(yīng)征人書面同意后,征集人可以使用應(yīng)征人的概念方案設(shè)計(jì)成果。但所有參與征集的成果文件在評(píng)審后不退回應(yīng)征人。
  4.The Host is entitled to use the conceptual scheme deliverables of the applicant with the latter’s written permission of the intellectual property rights of the latter’s unselected schemes.However,all the deliverables involved in the solicitation will not be returned to the applicant after the review.
  5、征集人在評(píng)審結(jié)束后公布評(píng)審成果,并有權(quán)對(duì)應(yīng)征人遞交的設(shè)計(jì)成果無(wú)償進(jìn)行印刷、出版和展覽,可通過(guò)傳播媒介、專業(yè)雜志、書刊或其他形式對(duì)設(shè)計(jì)方案進(jìn)行評(píng)價(jià)、展示和宣傳。在征得征集人書面同意后,應(yīng)征人可通過(guò)傳播媒介、專業(yè)雜志、書刊或其他形式評(píng)價(jià)、展示其設(shè)計(jì)方案的相關(guān)內(nèi)容。
  5.The Host will announce the results of the review after the end of the review and is entitled to print,publish and exhibit the deliverables submitted by the applicants free of charge,and evaluate,display and publicize the design schemes through communication media,specialized journals,books or other forms.After acquiring the permission of the Host in writing,the applicant may evaluate and display relevant contents of its design scheme through communication media,specialized journals,books or other forms.
  6、征集活動(dòng)結(jié)束前,應(yīng)征人或其設(shè)計(jì)人員未征得征集人和征集活動(dòng)組織單位的許可,不得以任何方式披露、公開(kāi)或展示設(shè)計(jì)成果,否則將依法追究其相應(yīng)法律責(zé)任,并取消其參與本次征集的資格。
  6.Before the end of the solicitation activity,the applicant or its designer must not disclose,make public or display the deliverables in any way without the permission of the Host and the organizer of the solicitation activity,otherwise the corresponding legal liabilities shall be ascertained in accordance with the law and its qualification to participate in the solicitation will disqualified.
  7、應(yīng)征人從征集人或征集組織單位獲得的文件資料應(yīng)妥善保管,不得泄露,也不得用于本次征集活動(dòng)以外的任何用途。應(yīng)征人須承擔(dān)因文件資料泄露等情況所帶來(lái)的法律責(zé)任(含賠償損失等)。
  7.The documents and materials obtained by the applicant from the Host or the soliciting organizer should be properly kept and must not be disclosed or used for any purpose other than the solicitation activity.The applicant shall bear the legal liabilities(including compensation for losses,etc.)arising from the leak of documents and materials.
  8、本次征集不允許任何形式的抄襲或剽竊,所造成的一切責(zé)任須由過(guò)錯(cuò)方承擔(dān),征集人不承擔(dān)任何法律責(zé)任。
  8.No form of copying or plagiarism is allowed in this solicitation,and all liabilities arising therefrom shall be borne by the faulty party,and the Host will not bear any legal liability.
  9、本次征集活動(dòng)公告與正式發(fā)布的《征集文件》有不符之處,以《征集文件》為準(zhǔn),征集人擁有本次公告的最終解釋權(quán)。
  9.For inconsistencies between the solicitation activity and the Solicitation Document that is officially released,the Solicitation Document shall prevail.The Host has the power of final interpretation of the announcement.
  10、未正式征集前,如遇政策發(fā)生變化等情況或其他不可抗力,征集人有權(quán)終止本次征集活動(dòng),最終解釋權(quán)歸征集人所有。

  11、本次征集的設(shè)計(jì)深度為內(nèi)容為景觀概念方案設(shè)計(jì)。本次征集涉及的建設(shè)工程的方案設(shè)計(jì)、初步設(shè)計(jì)和施工圖設(shè)計(jì)將按照《中華人民共和國(guó)招標(biāo)投標(biāo)法》的規(guī)定通過(guò)公開(kāi)招標(biāo)確定設(shè)計(jì)單位。

  11.The design depth of the Solicitation is landscape concept design.The design unit for schematic design,preliminary design and construction drawing design of the construction project involved in this solicitation will be determined by public bidding in accordance with the provisions of the Law of the People's Republic of China on Tenders and Bids.
